LR9 Contracts for Legal Services Between the School Board of Palm Beach County, Florida, the Rose Law Firm LLC , and Weiss, Handler, & Cornwell

Description

Mr. Sherrod, a former teacher, alleged First Amendment violations by School Board, Former Superintendent Johnson and Dr. Gloria Crutchfield related to employment decision in the case of Sherrod v. School Board, et al.  The School Board and other named Defendants prevailed on appeal in the Eleventh Circuit Court of Appeals.  Mr. Sherrod subsequently petitioned the Eleventh Circuit for rehearing which was denied.  Mr. Sherrod has filed a petition for certiorari in the U.S. Supreme Court concerning Dr. Crutchfield and Dr. Johnson in the case of Sherrod v. Johnson et al, Case No. 12-5125. 

The existing contract with the Rose Law Firm concerning the representation of the School Board and Gloria Crutchfield, Ph.D. in the federal appeal pending before the Eleventh Circuit Court of Appeals expired on June 30, 2012.  The revised contract will be effective from August 1, 2012 through June 30, 2014.  Under the revised contract, the Rose Law Firm will represent Dr. Crutchfield in the appeal pending before the U.S. Supreme Court, including the preparation of a response to the Petition for Certiorari.   The existing contract with Weiss, Handler, & Cornwell concerning the representation Arthur C. Johnson, Ph.D. in the federal appeal pending before the Eleventh Circuit Court of Appeals expired on June 30, 2012.  The revised contract will be effective from August 1, 2012 through June 30, 2014.  Under the revised contract, Weiss, Handler, & Cornwell will represent Dr. Johnson in the appeal pending before the U.S. Supreme Court, including the preparation of a response to the Petition for Certiorari.



Recommendation

I recommend the School Board approves the attached contract for the Rose Law Firm in the amount of $20,000 and authorize the Superintendent and Chairman to sign all needed documents to execute the attached contract.
