3. G2 - Penn Foster Virtual High School Academic/Career Solutions

Minutes: 

Penn Foster's solution for the School District of Palm Beach County includes, the delivery of a fully accredited high school program in which students can be enrolled for individual courses (credit recovery) or take the Penn Foster curriculum and receive a Penn Foster High School Diploma.

Additionally, Penn Foster will make available a selected number of career electives for those students wishing to pursue a career-oriented course. 

This partnership will include the following programs and services:

1.  A regionally accredited online high school program consisting of over 30 individual courses.

2.  Selected career electives.

3.  Online support to teachers and administrators so that they can view student records, test results, and generate reports to analyze student/class progress.

4.  On site start up instruction and training as well as documentation and support manuals for use in training additional staff.

5.  The School District of Palm Beach County will be reimbursed $25,000 through a DOE grant.

4. AC1 - Acquisition of WXEL

Minutes: 

Dr. Judith Garcia, Blair LittleJohn and Dr. Alison Adler provided Board Members with a presentation and discussion on the acquisition of WXEL.

provided a technical aspect of purchasing WXEL.

Dr. Johnson announced that this is a two step process and the purpose of today's workshop is to get authorization by the Board to begin negotiations.

Board Members discussed: date decision needs to be made; partnerships; and career academy internships.

Dr. Robinson stated that she can not support the purchase of WXEL due to the current budget crisis and the state of the economy.

Mr. Barbieri questioned if the $4.5 million being used to purchase WXEL can be used towards the operating budget.

On or about July 24, 2008 Rayburn White, a teacher, became the subject of an Employee Relations investigation based on allegations of ethical misconduct, failure to exercise best professional judgment and violation of 6B-1.001, (3) Florida Administrative Code, The Code of Ethics of the Education Profession in Florida.  Rayburn White's allegations also include potential violations of school board policy 1.013 (1) Responsibilities of the School District Personnel and Staff, Florida State Statutes; 800.03 exposing sex organ in public, 843.00 resisting arrest without violence and county ordinance 04.22(20) (c) loitering in public restroom.

On July 21, 2008, Rayburn White was arrested by the Palm Beach Sheriff's Office and charged with the following criminal offenses:  exposing sex organ in public, resisting arrest without violence and violation of county ordinance loitering in public restroom.

Based upon substantial information gathered through subsequent investigation, there is clear and convincing evidence to substantiate findings of ethical misconduct, failure to exercise best professional judgment, and violation of the Code of Ethics of the Education Profession in Florida.

I recommend that the School Board approve Rayburn White's suspension without pay, effective immediately. I further recommend that the School Board approve the termination of Rayburn White's employment effective January 6, 2009 subject only to appeal under Section 120.569, Florida Statutes.- PASS

An audit was conducted of Independence Middle School's student enrollment records and Full Time Equivalent (FTE) reporting for the period of July 1, 2007 through November 30, 2007.  The audit concluded the student count was inflated by 24 students.

Dr. Kathleen Carden, Assistant Principal, became the subject of an Employee Relation investigation regarding allegations of falsification of district documents, misconduct and unprofessional conduct.  Specifically, these allegations include potential violations of School Board Policies, Procedures, Bulletin Directives and the Code of Ethics of the Education Profession in Florida as follows:

6B-1.001, (3), Code of Ethics of the Education Profession in Florida, "Aware of the importance of maintaining the respect and confidence of one's colleagues, of students, of parents, and of other members of the community, the educator strives to achieve and sustain the highest degree of ethical conduct".

6B-1.006, (4) (b), Principles of Professional Conduct for the Education Profession in Florida, "Obligation to the public requires that the individual:  shall not intentionally distort or misrepresent facts concerning an education matter in direct or indirect public expression".

6B-1.006, (5) (a), Principles of Professional Conduct for the Education Profession in Florida, "Obligation to the profession of education requires that the individual:  shall maintain honesty in all professional dealings".

6B-1.006, (5) (h), Principles of Professional Conduct for the Education Profession in Florida, "Obligation to the profession education requires that the individual:  shall not submit fraudulent information on any document in connection with professional activities".

On or about November 19, 2008, Edris Francois, Stockperson Warehouse Driver became the subject of an Employee Relations investigation based upon allegations of conversion of school district funds and/or property, theft, ethical misconduct and unprofessional conduct.  Furthermore, allegations included potential violations of the Collective Bargaining Agreement, SEIU/FPSU, Article 17 (6), Discipline of Employee (Progressive Discipline), School Board Policy 1.013, Paragraph 1, Responsibilities of the School District Personnel and Staff and Florida Statute(s) Chapter 812.014 (1) grand theft and Chapter 539.001 (8) (8) (b) false verification of ownership (fraud).

On November 17, 2008, Mr. Francois was arrested by the Palm Beach County School District Police Department for Grand Theft and Fraud (10 counts).  The investigation surrounded the theft of school district property in excess of $22,000 (real cost) and $9,200 (depreciated value).  The items stolen were various computers, computer equipment and audio visual equipment.  Mr. Francois, without permission or authorization, stole these items and presented them to a local pawn shop as his property and made a lucrative profit off school district property.  Investigators were able to trace pawned school district items by Mr. Francois back to September 2006, which is approximately one year after he was hired by the school district.

Based upon substantial information gathered from the investigation there is a preponderance of evidence to substantiate the above allegations.
