On or about July 24, 2008, Rayburn White, a teacher, became the subject of an Employee Relations investigation based on allegations of ethical misconduct, failure to exercise best professional judgment and violation of 6B-1.001, (3) Florida Administrative Code, The Code of Ethics of the Education Profession in Florida.  Rayburn White's allegations also include potential violations of school board policy 1.013 (1) Responsibilities of the School District Personnel and Staff, Florida State Statutes; 800.03 exposing sex organ in public, 843.00 resisting arrest without violence and county ordinance 04.22(20) (c) loitering in public restroom.

On July 21, 2008, Rayburn White was arrested by the Palm Beach County Sheriff's Office and charged with the following criminal offenses:  exposing sex organ in public, resisting arrest without violence and violation of county ordinance loitering in public restroom.

Based upon substantial information gathered through subsequent investigation, there is clear and convincing evidence to substantiate findings of ethical misconduct, failure to exercise best professional  judgment, and violation of the Code of Ethics of the Education Profession in Florida.



Motions:
I recommend that the School Board approve Rayburn White's suspension without pay, effective immediately. I further recommend that the School Board approve the termination of Rayburn White's employment effective December 18, 2008 subject only to appeal under Section 120.569, Florida Statutes.-

On or about September 18, 2008, Karen Gadson became the subject of an Employee Relations investigation based upon the allegations of gross insubordination and misconduct-willful disregard for policy/directive and rules.  Furthermore, the allegations included potential violations of the Collective Bargaining Agreement, SEIU/FPSU, Article 17 (6), Discipline of Employee (Progressive Discipline), School Board Policy 1.013, Paragraph 1, Responsibilities of the School District Personnel and Staff and Florida Statute Title XLVIII, K-20 Education Code 1012.67, Absence without leave.

Ms. Gadson is a part-time custodian at Boca Raton Community High School.  Since April 17, 2008, Ms. Gadson has missed 271 hours of her scheduled work time without proper authorization.  The school administrative has done diligence in documenting Ms. Gadson's chronic absenteeism and tardiness.  The school administration has further attempted corrective behavior through the form of progressive discipline for insubordination to wit:  December 3, 2007, Ms. Gadson was given Written Directives with regards to Attendance and Employee Expectations; January 28, 2008, Ms. Gadson was issued a Verbal Reprimand (Written Notation) for Insubordination for failure to follow directives regarding attendance; February 6, 2008, Ms. Gadson was issued a Written Reprimand for Insubordination regarding attendance; April 17, 2008, Ms. Gadson was issued another Written Reprimand for Insubordination regarding attendance and on August 6, 2008, Ms. Gadson was given additional Written Directives regarding insubordination for attendance and that any further violation would be considered gross insubordination.

All forms of progressive discipline have failed.  Ms. Gadson continues to grossly and willfully disregard policy, directives and rules.

I further recommend that the School Board approve the termination of Karen Gadson's employment effective December 18, 2008, subject only to appeal under Section 120.569, Florida Statutes. - PASS
