PR3 Galaxy Elementary Easement Agreement
Description
- The School Board is currently constructing the replacement school for Galaxy Elementary. This project involved swapping property with the City of Boynton Beach. A portion of the school will now be built on the former City Park property. Property sold to the City located to the north of the two remaining Galaxy Elementary buildings will be the location of the Replacement City Park.
- The new school property is adjacent on its eastern property line to a 20-feet wide utility easement owned by the City of Boynton Beach.
- In conjunction with the modernization project for the school, the School Board requested permission from the City to place certain improvements (sod, fence) within the easement. This Agreement will allow for those improvements.
- This Agreement was heard by the Boynton Beach City Council and approved at the February 21, 2012 Council Meeting.
Recommendation
I recommend the School Board approve the Perpetual Access Easement, Maintenance Agreement & Declaration of Restrictions between the School Board of Palm Beach County, Florida, and the City of Boynton Beach affecting Galaxy Elementary School and authorize the Chairman and Superintendent to sign all necessary documents.

Maintenance costs associated with landscaping (grass cutting) and fence repair, when needed.
