PR1-Cancellation of Sprint Spectrum Lease Amendments for Generators at Okeeheelee MS., Calusa ES, Boca Raton HS and Plumosa ES

Description
  1. Following the storms of 2005 and 2006, Sprint Spectrum Realty Company (Sprint) requested amendments to the existing Lease Agreements to accommodate generators at four school sites that host their telecommunications towers.
  2. In order to accommodate this request, on August 15, 2007 and September 19, 2007, the School Board approved Amendments to the Site Specific Memorandum to Master Lease Agreement and the Site Specific Memorandum to Master Lease Agreement/Gift Agreement/Agreement Respecting Construction and Placement of Telecommunications Facilities to allow for generators and/or additional ground space, as follows (See 2007 Board Reports, Exhibit "A"):
    • Okeeheelee MS -130 additional square feet
    • Calusa Elementary - 100 additional square feet
    • Plumosa SOA Elementary ("Old" Atlantic HS)- 70 additional square feet
    • Boca Raton Community High School - Generator was to be located within the existing leased area.
  3. Sprint has since made a corporate decision not to proceed with the leasing of additional ground space for the installation of generators, due to a change in corporate policy (See attached letter,  Exhibit "B").
  4. Since Sprint did not proceed with the installation of the generators, the additional anticipated annual rental revenue of $2,400 per site for Okeeheelee Middle School, Calusa Elementary and Plumosa SOA Elementary ("Old" Atlantic HS) or a total of $7,200 per year will not be received.
  5. It is prudent to move forward with a formal cancellation of the Amendments, since the generators will not be installed.


Recommendation
I recommend the School Board approve the Amendments for the Site Specific Memorandum to Master Lease Agreement with Sprint Spectrum Realty Company, L.P to cancel the lease of additional ground space for generators at Okeeheelee Middle School, Calusa Elementary, Plumosa SOA Elementary ("Old" Atlantic HS) and Boca Raton Community High School; and authorize the Chairman and Superintendent to sign all necessary documents.

Financial Impact
