Title: Recommendation: I recommend that the School Board approve the Florida Department of Education amendments to the Special Programs and Procedures Document, and authorize the Superintendent, or designee, to sign all documents related to the amendments. Description: Section 1003.57(1)(d), Florida Statutes, requires that district school boards submit to the Department of Education proposed procedures for the provision of special instruction and services for exceptional students (SPP document) once every three years. This document serves as the basis for the identification, evaluation, eligibility determination and placement of students in special programs for exceptional students. In compliance with the final federal IDEA regulations implementing the 2004 amendments to the IDEA, the Department of Education (DOE) has revised certain State Board of Education Rules applicable to the education of students with disabilities. DOE has determined that the current SPP document, which has expired on June 30, 2007, will be extended for one year (effective July 1, 2007) with the specific amendments to ensure alignment with all federal and state laws. A summary of the amendments is attached. Amendments focused on eligibility for specific programs: Deaf or Hard of Hearing; Physically Impaired; Traumatic Brain Injury; Emotional/Behavior Disabilities (formerly Emotionally Handicapped and Severely Emotionally Disturbed); Autism Spectrum Disorder. Other amendments to the SPP were added to comply with federal law. There are no options for the local districts to change the amendments as provided by the DOE.
